A recent Montana Supreme Court decision suggests that restrictive covenants are not likely to be enforced when an employer fires an employee without cause in Montana. The decision is both consistent and inconsistent with the opinion of other courts around the country.

Following the lead of 46 other states and the District of Columbia, New Jersey has passed its own version of the Uniform Trade Secrets Act. The law has been sent to the Governor for signature.

After years of conflicting opinions and oddly phrased descriptions of legitimately protectable interests, Illinois has now joined the mainstream with respect to restrictive covenants.
